Exactly. If they try to enforce this, it end up in the courts and almost certainly will be struck down.

I think this part could land:

“a scheme to pay for goods or services, including NIL services, above the actual fair market value of those goods or services in connection with a student-athlete’s participation in intercollegiate athletics, including through the use of collectives or similar entities.”

You really aren’t allowed to pay players to play. You just can’t bar them from earning income from selling their name, image, and likeness. I think if they sued the donors and universities and said, “this isn’t market value, the amount you paid couldn’t reasonably have been recouped through the publicity gained, you’re clearly paying the player to attend the school and you’re conspiring with the university to do this,” that might be a winnable case, but I think it should be winnable now without the EO based on existing NCAA regulations.

He announced that he will be sued while signing this executive order. I’m just glad he’s stoking the fire to get this mess cleaned up.

It has to start somewhere It doesn’t change a school from paying what they consider fair market value so that doesn’t change the way it is now except third party contributions. It may take two years or more to change it
